The NSW Government Licensing Web site provides proprietors of registered business names with access to certain particulars relating to their existing business name registration/s.

Your rights to privacy

The Web site must comply with the NSW Privacy and Personal Information Protection Act 1998 which regulates, among other things, the collection, storage, use and disclosure of personal information.

Collection of information

Information that in some way identifies you may be gathered during your interaction with our website in the following circumstances.

1. Collection of website usage information

When you browse our Web site, our service provider logs the following information for statistical purposes – your server address, top level domain name (eg .com, .gov, .au, .uk etc) the date and time of your visit, the pages accessed, documents downloaded, the previous site visited and the type of browser used.

We will not try to identify users or their browsing activities, except in the event of an investigation, where a law enforcement agency may exercise a warrant to inspect the service providers logs.

2. Collection of personal information

The main way we would collect personal information from you is if you used our site to create a user profile and lodge a renewal or amendment form in relation to a licence or registration. This personal information may include your full name, date of birth, phone and fax numbers, email address and street and postal address.

Access to and alteration of records containing personal information

The Privacy and Personal Information Protection Act allows individuals to access and alter records containing their personal information. This website enables you to view and amend certain personal details online at any time during the period that the licence or registration is current. The Freedom of Information Act also sets out the process by which you can access, change or annotate records held by the licensing agencies, which contain your personal information.

Information storage and security

Personal information is stored in transmission logs and archived in accordance with the State Records Act.

Where appropriate our website provides a secure environment by using Secure Sockets Layer (SSL). This establishes a session, encrypts all traffic, between our Web server and your browser.

Use and disclosure of information

We will only use your personal information (including your email address) for the purpose for which you have provided it, eg for a licence or registration renewal. We will not use it for any other purpose, nor will we disclose it, unless with your consent or in other circumstances where such use or disclosure is permitted under the Privacy and Personal Information Protection Act.

The details of business name registrations are also recorded on the Public Register maintained by Fair Trading. Any person can search the Public Register by lodging an application and paying the prescribed fee.

The Office of Fair Trading reserves the right to make disclosures to relevant authorities where the use of the website raises a suspicion that an offence is being committed.

We welcome your feedback about this Privacy Statement and about our site’s design and practices. You can use the Contact Us email facility on our Web site for this purpose. The provision of personal details is optional. You may provide personal details for the purposes of receiving a reply to your feedback comments.

Access to and use of this personal information is limited to approved staff of the Office of Fair Trading. Fair Trading may publish aggregated information about feedback on the site, to the extent that it does not identify or cannot be used to identify individual users of the site.

REFUND POLICY

Where an application for renewal of a business name has been refused by the Office of Fair Trading, the appropriate refund amount will be paid by means of a cheque made out to the proprietor of the business name and mailed to the business address.

Acceptance of Terms and Conditions

The NSW Government makes this Website service available to you on the terms and conditions set out hereunder. You will have been taken to have accepted these terms and conditions when you click on the ACCEPT button.

Services

The NSW Government will provide you with online access to your business name registration held by the Office of Fair Trading. This access will enable you to view certain information regarding an existing business name registration held by you, to renew that registration online and to make changes to some specified particulars relating to the registration. Lodgement of an application for renewal or change of particulars of a registration does not indicate that the application has been approved. The application will be assessed by the Office of Fair Trading and you will be notified of the decision by mail.

It is impossible for the NSW Government to ensure that the services are provided to you at all times or at any specific times or will be able to operate at all times error-free. After hours provision of services are influenced by availability of related computer systems. The NSW Government makes no warranties in regard to the services but all reasonable efforts will be made to provide the services to you. Notices regarding availability of the system will be made available on the Web site’s home page.

Reference number, username and password

Your reference number, username and password are very important pieces of information and it is your responsibility to keep them secure. You agree to:

If you suspect that someone may know your current reference number before you have used it to log in to the system you agree to advise the Office of Fair Trading.

If you suspect that someone may know your password, you agree to login and change it immediately and to also advise the Office of Fair Trading in writing, eg using the Contact Us email facility on the Website, of the suspected breach of the password.

You agree that you will be responsible for any transactions made on your registration record using the reference number, username or password.

Credit card payments

You agree that a payment instruction that is given before the cut-off time for a banking business day will be processed on the same day but if it is given after the cut-off time it may be processed on the next banking business day after the instruction is given.

Should your bank reverse your credit card payment for any reason, the renewal and/or change in particulars made in relation to that credit card transaction may also be reversed. This could have implications for the continuation of your registration. You are responsible for ensuring that payments are made only using valid credit cards.

Access to the service

Your access to the service will be denied if you enter an incorrect password on several consecutive occasions.

The NSW Government reserves the right to deny or revoke access to the Web site as it sees fit.

Governing law

Your access to and use of the services is governed by the law in force in New South Wales and you agree to submit to the non-exclusive jurisdiction of the courts in that State.
